1. The petitioner has filed the present petition under Section 11(5) of the Arbitration and Conciliation Act, 1996 for appointment of an arbitrator.

2. The parties had entered into a Dealership Agreement dated 27.09.2004 which contains an arbitration clause. Certain disputes have arisen between the parties in relation to the said agreement.

3. None of the aforesaid facts are disputed and, therefore, an Arbitrator is required to be appointed.

4. The parties are agreeable that an Arbitrator be appointed under the Rules of the Delhi International Arbitration Centre (DIAC). Accordingly, it is directed that a sole arbitrator be appointed under the Rules of DIAC.

5. The representatives of the parties shall appear before the coordinator, DIAC on 06.10.2016 at 11:00 AM.

6. The arbitration shall be conducted under the aegis of DIAC and in

accordance with its Rules.

7. The Registry is directed to send the copy of this order to the DIAC.

8. The petition is disposed of.
