% 29.07.2016 Issue notice. Mr.Kundu appears on behalf of the State. Respondent No.2 is present in person and he accepts notice. He is identified by the Investigating Officer. The petitioners are present in Court along with their counsel.
The present petition has been filed to seek quashing of the FIR No.424/2016 registered under Section 308/ 34 IPC at Police Station - Nand Nagri, Delhi against the petitioners. The petition is premised on settlement arrived at between the complainant/ respondent No.2 and the petitioners. Learned counsel for the petitioners submits that the petitioners and
respondent No.2 are cousins. On account of an altercation between them, the aforesaid FIR came to be registered. However, the parties have now resolved their disputes.
Respondent No.2, who is present in Court states that he has arrived at the settlement of his own free will and without any force or coercion. The petitioners are related to him as his cousin brothers. The petitioners are warned against any violent conduct in future. They undertake to the Court that they shall mind their conduct in future and shall not indulge in any violence much less against respondent No.2. In view of the aforesaid, no useful purpose would be served in keeping the aforesaid FIR pending any further. The same is, accordingly, quashed.
