% 11.01.2017 C.M. Nos.14873/2016 (restoration) & 14874/2016 (delay) This Court notes the prayer made in the petition. The prayer made in the petition is that on the basis of the registered Will, the property in question i.e. House No. 16, Link Road, Lala Lajpat Rai Road, New Delhi should not be mutated in favour of the private respondents namely respondents No. 4 & 5 and action to the said effect should not be taken by the SDMC on this count. On advance notice, learned counsel for the respondents have put in appearance.

Learned counsel for respondents No. 4 & 5 (private respondents) submits that the property already stands mutated in their favour. It is an admitted fact that the petitioner is the sister of the private respondents i.e. respondents NO. 4 & 5. They have a private

dispute pending which is in the nature of Test Case i.e. Test Case No.74/2014 which is pending adjudication.

Noting these above submissions, this Court is of the view that the present applications have been rendered infructuous as the prayer in writ petition is itself no longer survives. Applications are accordingly disposed of.
