O R D E R

1. This is a joint application by the parties for disposal of the appeal in terms of the settlement arrived at between them, terms of which have been set out in paragraph 4 of the application.

2. The Court finds that the application has been signed both parties and their counsel and is supported by an affidavit of the authorized representatives of both the parties.

3.Pursuant to the above settlement, a sum of Rs. 2,50,000 by way of a demand draft has been handed over to the counsel for the Appellant, which is acknowledged by him. Now it is agreed between the parties in terms of the settlement that the Rs.2,50,000/- will be paid by the Respondent to the

Appellant before the District Court, as already agreed inter se the parties.

4. In that view of the matter the application is allowed and the appeal is disposed of in terms of the settlement arrived at between the parties as set out in para 4 of the application which shall form part and parcel of the said order. In the event that there is any default in compliance of the terms of settlement, it will be open to the parties to apply to the Court for directions.
