O R D E R

% 21.08.2018 It is submitted that a settlement has been arrived at between the petitioner and respondent no.2. Petitioner has offered to pay ₹2.5 lacs to the respondent no.2 towards full and final settlement of the amount involved in the cheque in question. Respondent no.2 has accepted this offer and has no objection in case the offence under Section 138 of the Negotiable Instruments Act, 1881 (the N.I. Act, for short) is permitted to be compounded. Counsel for the petitioner submits that ₹2.5 lacs, which is lying deposited in this Court, may be released to the respondent no.2. In view of the settlement arrived at between the petitioner and respondent no.2, offence under Section 138 of the N.I. Act is permitted to be

compounded and petitioner is acquitted. The amount lying deposited in this Court be released by the Registry together with interest, if any, to the respondent no.2 forthwith.

Petition is disposed of in the above terms.
