% 08.05.2017 At the outset the learned counsel for the respondent has handed over a list of approved conciliators/arbitrators and states that the respondent would not have any objection if the petitioner nominates it's arbitrator from this list.
The learned counsel appearing for the petitioner, on instructions, states that the petitioner nominates J. Mukul Mudgal (Retd.) former Chief Justice, Punjab & Haryana High Court as its arbitrator. The learned counsel for the respondent confirms that the respondent would nominate its arbitrator within a period of one week from today. Once, the respondent nominates its Arbitrator, both the Arbitrators would jointly nominate the third Arbitrator. In the event
the arbitrators are unable to nominate the third arbitrator, the parties would be at liberty to approach this Court. It is also clarified that in case the respondent fails to nominate its arbitrator within a period of one week from today, the petitioner is at liberty to revive the present petition for appointment of an arbitrator on behalf of the respondent. With these directions and clarifications, the petition is disposed of.
