% 01.06.2016 (1) The petitioner seeks anticipatory bail in case FIR No.1045/2015 under Sections 420/406/467/468/471/380/454/506/451/120B IPC registered at Police Station K.M.Pur. Status report is on record. (2) I have heard the learned counsel for the parties including the complainant's counsel and have perused the file. During the course of arguments, it was informed that the matter has been settled with the complainant and the petitioner is to pay `26,00,000/- (Rupees twenty six lacs only) in all in full and final satisfaction of the claims. Complainant's counsel has denied it. It is agreed that let 50% of the BAIL APPLN. 1110/2016
alleged settled amount i.e. `13,00,000/- (Rupees thirteen lacs) be given to the complainant without prejudice at this stage. On this, the complainant has no objection to the grant of bail. (3) `3,00,000/- (Rupees three lacs) have already been received by the complainant. `10,00,000/- (Rupees ten lacs) [by way of demand drafts bearing Nos.071941 & 071942 for the sum of `2,00,000/- each drawn on Vijaya Bank; Cheque bearing No.102670 drawn on ICICI Bank, dated 25.06.2016 for the sum of `1,25,000/-; and Cheque bearing No.789581 drawn on Vijaya Bank dated 01.09.2016 for the sum of `4,75,000/-] have been given to the complainant today in court.
(4) Considering the facts and circumstances of the case, the petitioner is admitted to anticipatory bail and in the event of his arrest, he be released on bail on his furnishing personal bond in the sum of `50,000/- with one surety in the like amount to the satisfaction of the SHO/Investigating Officer with the condition that he shall join the investigation as and when required.
`13,00,000/- (Rupees thirteen lacs) given to the complainant are without prejudice and subject to future adjustment (if any).
(5) The bail application stands disposed of.
