The petitioner is aggrieved by order dated 22.06.2018 whereby the trial court has directed the prescribed officer to conclude the inquiry in terms of judgment of the Supreme Court in Dr. Subhash Kasinath Mahajan Vs. State of Maharashtra in Crl. Appeal No. 416 of 2018.

Learned counsel for the petitioner submits that in terms of the law laid down by Dr. Subhash Kasinath Mahajan (Supra) inquiry is to be conducted in a time bound manner and should not exceed seven days. Learned counsel for the petitioner submits that the concerned CRL.M.C. 3273/2018

officer has delayed the inquiry and the trial court should have proceeded with the matter in terms of the directions issued by this Court on 18.06.2018 in Writ Petition (Crl.) 1864/2018. 3.

Learned Addl. PP for the State submits that inquiry has been concluded and no case is found to be made out. She further submits that the matter is listed on 11.07.2018 and the report shall be duly submitted by the trial court.

In view of the statement of learned Addl. PP that no case is found to be made out, no further order are required to be passed in this petition. However, trial court is directed to dispose of the proceedings in terms of the directions as issued by this Court on 18.06.2018 as also the judgment of the Supreme Court in Lalita Kumar Vs. Govt. of UP & Ors. (2014) 1 SCC (Crl.) 524.
