% 17.07.2017 CRL.M.A. 13617/2016 It is submitted that petitioner no.1 and respondent no.2 have settled their dispute before the Counselling Cell of Family Court (Central District) Delhi vide settlement deed dated 27.08.2015. Therefore, FIR o. 47/2010 under section 498-A/406/34 IPC registered at PS Burari on the complaint of respondent no.2 may be quashed. Certified copy of compromise / settlement deed has been placed on record at pages no. 46 to 51. Respondent no.2 is present in Court and has been identified by SI Rajbir Singh of Police Station Burari. Respondent no.2 admits having been settled the matter with petitioner no.1. She says that petitioner no.1 has already given talaq. She further submits that she has already withdrawn other cases as mentioned in compromise / settlement deed.

Petitioner no.1 has paid Rs. 1,50,000/- to respondent no.2 in Court vide a demand draft. Photocopy thereof has been placed on record. Respondent no.2 says that she is not willing to pursue the aforesaid FIR any further and the same may be quashed. Petitioners no.2 to 5 are relatives of petitioner no.1.

Keeping in mind the settlement arrived at between the petitioner no.1 and respondent no.2, in the interest of Justice, aforesaid FIR and the consequent proceedings emanating there from are quashed.

Petition is disposed of.
