By way of this writ petition filed under Article 226 of the Constitution of India read with Section 482 Cr.P.C., petitioners are seeking quashing of case FIR No.170/2016 under Sections 376/354/313/506/34 IPC registered at PS Pahar Ganj.

Status report on behalf of the State has been filed as per which charge-sheet has been filed and the case is at the stage of committal proceedings, as one of the accused namely Manish has not appeared before the learned Metropolitan Magistrate. It is also mentioned in the status report that learned Trial Court has issued NBW against the accused Manish for his appearance on 20th November, 2017.

In view of the above, the writ petition is dismissed with liberty to the petitioners to raise all the contentions before the learned Trial Court. PRATIBHA RANI, J.
