% 06.01.2016 The learned counsel for the appellant says that they have in fact paid the respondent in terms of the impugned judgment and decree. In other words, it is the submission of the learned counsel for the appellant that the decree has been satisfied. The learned counsel for the respondent says that the entire amount under the impugned judgment and decree has not been received by the respondent.
Therefore, even according to the counsel for the parties, the issue, which has arisen, in the appeal, is, with regard to the computation of the decretal amount. This is an exercise which the executing court is competent to carry out. Thus the appeal is disposed of, with a direction to the executing court to examine the calculation RFA 446/2014
for computation of decretal amount supplied by the parties herein and thereafter, arrive at the decision as to whether or not the decree has been satisfied as contended by the appellants herein. For this purpose, the parties and their counsel shall appear before the executing court on 10.02.2016.
The Registry will despatch a copy of this order to the concerned executing court.
