% 10.04.2017 Respondent no.2 (complainant) is present in Court along with her counsel and has been identified by ASI Vinod Kumar of police station Tilak Nagar.
Respondent no.2 admits having settled the matter before the Delhi High Court Mediation and Conciliation Centre on 28th July, 2016 vide Annexure P2.
She further submits that her marriage with petitioner has already been dissolved by decree of divorce by mutual consent dated 7th March, 2017 passed by Principal Judge, (West), Tis Hazari Courts, Delhi.
Petitioner has paid `10 Lacs by way of demand draft to respondent no.2 in Court towards balance settled amount. Photocopy of the demand draft has been placed on record.
Respondent no.2 says that she has no objection in case FIR is quashed.
Keeping in mind the settlement arrived at between the petitioner and respondent no.2 and further that their marriage has already been dissolved by decree of divorce by mutual consent, I am of the view that no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, FIR No.
1357/2015 under Sections 498A/406/34 IPC registered at police station Tilak Nagar, is quashed. Since FIR has been quashed, LOC, which is stated to be issued pursuant to present FIR, is revoked.
Petition is disposed of in the above terms.
