The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No.70/2015 registered under Sections 120B/406/420/467/468/471 IPC at PS Okhla Industrial Estate, New Delhi. Status report is on record.

I have heard the learned counsel for the parties and have examined the file. By an order dated 27.03.2015, the petitioner was granted interim protection and was directed to join the investigation as and when required. Undisputedly, the petitioner has joined the investigation since then. Learned APP has informed that vide order dated 10.08.2015 co-accused Renu was granted regular bail by the learned Metropolitan Magistrate on her offer to pay `25 lacs to the complainant. By an order dated 26.08.2015 co-accused Anil Kumar was also granted regular bail by learned Addl. Sessions Judge on his BAIL APPLN. 594/2015

offer to pay full and final payment of `55 lacs to the complainant. Apparently, the alleged cheated amount of `80 lacs has already been received by the complainant from co-accused Anil Kumar and his wife Renu.

The matter is stated to have been settled by the complainant with them.

It appears that for that reason, the complainant has not put appearance before this Court. The petitioner was not beneficiary. Only allegations against her that she conspired with co-accused Renu and Anil Kumar to cheat the complainant. 3.

Considering the facts and circumstances of the case, the petitioner is granted anticipatory bail and in the event of arrest, she be released on furnishing personal bond in the sum of `50,000/- with one surety in the like amount to the satisfaction of the SHO/Investigating officer. She shall, however, join the investigation as and when required.

The bail application stands disposed of.
