% 12.04.2018 By this petition the petitioner seeks quashing of FIR No. 534/2016 under Sections 451/376/506 IPC registered at PS Bawana on the ground that parties have settled the matter. Learned counsel for the petitioner even on merits presses quashing of FIR in question.

As respect quashing of the above-noted FIR on the basis of compromise is concerned, in view of the decisions of the Supreme Court reported as 2012 (10) SCC 303 Gian Singh Vs. State of Punjab & Anr. and (2014) 6 SCC 466 Narinder Singh and Ors.vs. State of Punjab and Anr., the offence under Section 376 IPC being serious in nature FIR in question cannot be quashed.

Faced with this situation learned counsel for the petitioner seeks leave to withdraw the petition.

Petition is dismissed as withdrawn.
