% 25.10.2016 1.

This petition by way of Public Interest Litigation has been filed alleging unauthorized constructions over five properties named in Para 16 and seeking a direction to the respondent No.1/South Delhi Municipal Corporation to take action for demolition of the same. 2.

A short affidavit dated 02.08.2016 was filed on behalf of SDMC stating that all the five constructions were found to be unauthorized and that steps have been initiated for removal of the same following due process of law. The said affidavit was taken on record on 17.08.2016 and SDMC was called upon to file the compliance report.

3.

Accordingly, Action Taken Report dated 24.10.2016 has been filed by the Executive Engineer (Building), South Zone, SDMC explaining the steps

that have already been taken.

We have perused the same and heard the learned counsel for both the parties.

4.

It is also represented by Shri Ajjay Aroraa, the learned Standing Counsel for SDMC that the concerned SHO has been instructed to take all necessary steps and to ensure that no such unauthorized construction would take place over the properties in question.

5.

The Action Taken Report and the statement of the learned Standing Counsel are placed on record and the writ petition is accordingly disposed of.
