Learned counsel for the plaintiff, after arguments, seeks and is granted liberty to withdraw the suit inasmuch as it is stated that the fresh suit is proposed to be filed taking the partnership firm of M/s Bawa Masala Company as a partnership firm and not as an HUF business, but rights are available to the plaintiff because on the death of her father late Sh.Jasbir Singh on 4.7.2004 his share in the partnership firm devolved not only to the defendant no.3/adoptive mother but also to the plaintiff who is an adopted daughter and hence entitled to the share of her father in the partnership firm of M/s Bawa Masala Company .
