% 29.08.2017 This is an application filed under Section 438 Cr.P.C. filed on behalf of the petitioner for grant of anticipatory bail in case FIR No.031233/2016, under Section 379 IPC registered at Police Station-Mukherjee Nagar, Delhi. Learned counsel for the petitioner has submitted that the petitioner is innocent person having no nexus with the allegations as alleged in the FIR. Counsel further submits that the petitioner has already joined the investigation in the above case and nothing has been recovered at the instance of the present petitioner and further submits that, if required, the petitioner is further ready to join the investigation and prays that the petitioner may be released on anticipatory bail. Status report has been filed by the State. Learned APP for the State on instructions submits that the petitioner has joined the investigation and the charge-sheet is likely to be filed very soon. He, however, opposes the
bail application.
In these circumstances, the petitioner is further directed to join the investigation as and when directed and in the event of his arrest he be released on anticipatory bail, on his furnishing bail bond in the sum of Rs.10,000/- with one surety of the like amount to the satisfaction of IO/SHO concerned with the direction that he shall not tamper with the prosecution evidence and shall not leave the country without prior permission of the concerned Court.
The present bail application is allowed and stands disposed of accordingly.
