O R D E R

% 12.10.2017 Learned counsel for the parties submit that the Arbitral Tribunal has been constituted by the parties comprising of Mr.JusticeT.S.Thakur (Retired), Mr.Justice A.K.Patnaik (Retired) and; Mr.Pramod Kumar, Retired (Railways). The Arbitral Tribunal has also held its first sitting on 28.7.2017. It is agreed by the parties that the present petition under section 9 of the Arbitration and Conciliation Act, 1996 be converted into a petition under section 17. Learned counsel for the petitioner agrees that the petitioner will file a fresh petition before the learned Arbitral Tribunal under section 17 of the Act. The learned Tribunal may deal with the application, as per law. The interim orders passed by this court on 29.3.2017 shall continue to operate until vacated/modified/varied/confirmed by the learned Tribunal, as per law.
