O R D E R
% 08.06.2016 The petitioner has filed the present petition seeking mandamus to the respondent to accept the applications for grant of provisional registration/municipal license of the members of the petitioner association for running their household industry in Dharampura, Dharampura Extension, Gandhi Nagar, Delhi. It is contended that the member of the petitioner association had earlier applied but the applications were returned seeking further documents for clarification. It is contended that the complete application and documents were sought to be furnished to the respondent, there is no authority or address where the said applications could be filed. Counsel for the respondent submits that the application can be
filed with the Factory Licence Department of the respondent no.2. Let the application be filed by the members of the petitioner association within a week from today. On filing of the application, the same would be scrutinised by the competent authority to ascertain whether any further document/clarification is required from the applicant. In case any document/clarification is required, the applicant shall be intimated within one week. The applicant shall thereafter within a week of receiving such intimation furnish the additional information sought for. On receipt of the completed application, the authority shall process the same and take a decision thereon within three months thereafter. The decision so taken shall be communicated to the applicant. In case the applicants are aggrieved by the decision, they shall be at liberty to initiate such proceedings as may be available in law.
Till the applications are disposed of, the respondent shall not take any further coercive action against the members of the petitioner association. Petitioner is directed to furnish a complete list of its members to the respondent within three days from today. The writ petition is accordingly disposed of in above terms. A copy of this order be given dasti under the signatures of the Court Master.
