O R D E R

% 14.07.2016 Marital discord between petitioner No.1/husband and respondent No.2 (complainant/wife) had led to registration of the present FIR under Sections 498A/406/34 IPC at Police Station Tilak Nagar, New Delhi. Husband and wife have now settled their disputes before the Delhi Mediation Centre, Tis Hazari Courts, Delhi on 18th August 2015. Settlement has been recorded in the proceedings of the Mediation Centre (Annexure- P-2).

Learned counsel for the petitioners and respondent No.2 submits that marriage between the

petitioner No.1 and respondent No.2 has already been dissolved by a decree of divorce by mutual settlement on 8th April 2016 by the Principal Judge, Family Court, (West), Tis Hazari Courts, Delhi in terms of the settlement. Bank draft for Rs.60,000/- has been handed over by the petitioner to the respondent No.2 in Court today towards remaining settlement amount. Respondent No.2 submits that she has no objection if the FIR and the proceedings emanating therefrom are quashed.

Keeping in view that the husband and wife have settled their disputes amicably, they parted their ways, in my view, no fruitful purpose would be served in keeping the criminal proceeding pending. Accordingly, in the interest of justice, FIR No.145/2014 registered at PS Tilak Nagar, New Delhi under Sections 498A/406/34 IPC and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms.
