This petition is filed assailing order dated 9th January 2017 of the Additional Sessions Judge, dismissing the Revision Petition preferred by the petitioner herein, against order dated 6th October 2016, passed by the Metropolitan Magistrate, dismissing application under Section 156 (3) Cr.P.C. filed by the complainant-petitioner.

The crux of the issue was basis a complaint filed by complainantpetitioner alleging that in 2013 they had availed business loan facility from accused no.1 NBFC. A loan was sanctioned and a deposit was made with NBFC Company by the complainant. A loan agreement was signed on 7th May 2013 and was thereafter disbursed. The allegation essentially focusses on collateral security that was furnished to accused which, according to complainant, are being misused by the accused-respondent. 3.

has traversed the facts and concluded that the loan agreement was voluntarily executed by the complainant-petitioner knowing its ramifications, and the dispute being of civil nature; no purpose would be served by investigation of the police.

The Revisional Court has also examined the matter and concurred with the findings of the Metropolitan Magistrate.

This Court does not see any reason to interfere with two concurrent findings of the Courts below.

The petition is accordingly dismissed along with pending applications, if any.
