The limited grievance raised by the petitioner in the present petition is non-decision on the part of the respondents/ITBP in respect of the representations submitted by him including the representation dated 05.06.2018 praying inter alia for grant of the 2nd financial upgradation under the ACP Scheme w.e.f. 26.06.2000 and further the benefit of the 3rd financial upgradation under the MACP Scheme w.e.f. 26.06.2006.

Learned counsel for the petitioner states that his client will be satisfied if the respondents are directed to decide the aforesaid W.P.(C) 6848/2018 Page No.1 of 2
pending representation in a time bound manner. 3.
In view of the submissions made hereinabove, a direction is issued to the respondents to examine and decide the petitioner's representation dated 05.06.2018 within six weeks under written intimation to him. It is made clear that while deciding the petitioner's representation, the respondents will also consider the decision of the Supreme Court in Union of India & Ors. Vs. Balbir Singh Turn & Anr. reported as (2018) 11 SCC 99.

If the grievance of the petitioner still survives he shall be entitled to seek legal recourse, as may be available. 5.
The present petition is disposed of alongwith the pending application.
