% 09.10.2017 IA No.10266/2017 This is a joint application under order XXIII Rule 3 read with Section 151 CPC moved by the petitioner and respondent No.2 stating interalia the disputes have been settled between the parties vide registered family settlement dated 4.09.2017, registered before the Sub-Registrar-V, Hauz Khas, Mehrauli. The Family Settlement Agreement dated 4.09.2017 is annexed as Annexure-A. It is submitted by the learned counsels for the parties that the settlement has been arrived at with free will of the parties and without any force or coercion. The parties undertake to abide by the terms and conditions set out in the Family Settlement Agreement dated 4.09.2017. In the circumstances, learned counsel for the petitioner submits that the suit may be dismissed as withdrawn.
In view of above, the petition is dismissed as withdrawn.
