% 05.08.2016 The present petition has been filed under Section 14 of the Arbitration and Conciliation Act, 1996 with the prayer to terminate the mandate of Sole Arbitrator. It is mentioned in para AA of the petition it is mentioned that the proceedings were commenced before the Arbitrator and after completion thereof, on 26th October, 2012 the matter was reserved for orders, however, the order has not been pronounced. Therefore, the present petition is filed by the respondent. The respondent has not filed the reply. However, learned counsel for the respondent submits that in case the arbitrator publishes the award within three months, then there is no need to file the reply. The said suggestion is agreeable to the counsel for the petitioner. Under these circumstances, the Arbitrator is directed to publish the award as early as possible and positively within three months from today.
Liberty is granted to the petitioner to revive the petition in case the Award is not passed within three months from today, the appropriate order would be passed thereafter.
