O R D E R

% 23.01.2017 The learned counsel appearing for JD No.1 states that a petition under Section 34 of the Arbitration and Conciliation Act, 1996 is still pending.

In view of the decision of the Division Bench of this Court in FAO(OS) No.221/2016 (ARDEE Infrastructure Pvt. Ltd v. Ms. Anuradha Bhatia), the present petition for enforcement of the arbitral award is premature.

Accordingly, the present petition is dismissed with liberty to the Decree Holder to apply afresh subject to the outcome of the petition under Section 34 of the Act.
