% 16.08.2016 By the present petition the petitioner seeks anticipatory bail in case FIR No.541/2015 under Sections 363/376/120B//34 IPC read with Section 6 of POCSO Act.

Learned counsel for the petitioner contends that the petitioner is not the main accused. The allegations against the petitioner are only permitting the complainant and the main accused to stay in a rented accommodation. The petitioner was never present along with the prosecutrix and the main accused at any point of time.

Learned APP for the State has handed-over a status report which is taken on record. The allegations in the FIR against one Arjun S/o the BAIL APPLN. 1177/2016

petitioner is that the complainant and Arjun eloped after telling a lie to the parents that she is married with him. She further stated that Arjun kept her in a rented house for one month and had physical relations resulting in the pregnancy where after he gave her some tablets due to which the child got aborted and thereafter she came back to her house. In the statement under Section 164 Cr.P.C. the allegations against the petitioner are that the petitioner threatened the complainant that he would not permit Arjun to marry the prosecutrix and she should leave the rented accommodation.

Considering the allegations against the petitioner, I deem it fit to grant anticipatory bail to the petitioner. It is therefore directed that in the event of arrest the petitioner be released on bail on his furnishing a personal bond in the sum of `25,000/- with one surety of the like amount subject to the satisfaction of the arresting officer/ SHO concerned, further subject to the condition that he will join the investigation as and when directed and will not leave the country without the prior permission of the Court concerned. Petition is disposed of. Order dasti.
