The name of the applicant figures in the FIR registered on 21.10.2016. As per the allegations made therein, the applicant was present with two other accused namely Anil Gupta and Dilbar Hussain on at least two occasions namely 31.07.2016 and 02.08.2016, the second time at the house of the Dilbar Hussain, she having been introduced as a business partner. The co-accused Dilbar Hussain evaded the process leading to even proclamation under Section 82 Cr. PC having been issued. He eventually was arrested on 08.04.2017 and the disclosures made by him during interrogation point to the involvement of the applicant.

In the facts and circumstances of the case where money was taken from the complainant on representation of Dilbar Hussain being the owner of certain parcel of land, the same having been found to be property owned instead by the family of Iftikhar Ali, it cannot be said the accusations against the applicant are unfounded. It has to be borne in mind that a case of another cheating involving similar modus operandi is also under investigation vide FIR no.431/2016 involving offences punishable under Section 420, 406, 507 IPC of PS Sachedi, Kanpur, UP, where also the name of the applicant as one of the perpetrators of the crime has figured.

The application for anticipatory bail is thus dismissed. R.K.GAUBA, J.
