% 29.08.2017 After some hearing, learned senior counsel appearing for the appellant states that he would not press the present appeal and the application seeking condonation of delay, if the appellant is given liberty to file an application for modification of the impugned order in view of the altered and changed circumstances. It is stated that plaintiff No.2 is major and also that the respondent is now 65 years of age.
In view of the statement made, the application for condonation of delay and the appeal are dismissed as not pressed.
In case the appellant files an application for modification of the order dated 17th September, 2015, the same would be considered in accordance with law. Of course, the respondents would be entitled to contest the same. SANJIV KHANNA, J.
