% 30.11.2017 I.A.No.14914/2017 & CS(COMM) 638/2016 This is an application filed under Order 23 Rule 3 read with Section 151 CPC jointly by the plaintiff and the defendants seeking to place on record a compromise/settlement.

The terms and conditions of the compromise/ settlement that has been arrived between the parties are reproduced in para 3(i), (ii), (iii), (iv) and (v) of this application. The application is allowed.

The terms and conditions of the compromise/settlement are legal and valid. The defendants have also by means of notional damages handed over a demand draft of Rs.1 lacs, bearing No.734345, dated 09.06.2016, drawn on Allahabad Bank in favour of the plaintiff to the learned counsel for the plaintiff.

The suit is decreed in terms of the said compromise/settlement. The decree sheet shall contain the terms and conditions of the compromise/settlement as stated in para 3(i), (ii), (iii), (iv) and (v) of this application. The suit is disposed of.
