% 22.04.2016 I.A.No. 4877/2016(U/s 151 CPC for revival of the suit) By the order dated 28.10.2015, this suit for partition was disposed of with liberty to revive the suit after testamentary case with respect to the Will dated 1.12.1999 of late Sh.Harkishan Lal is decided. An appeal was pending against the judgement passed in the testamentary case and which appeal is still pending, and therefore, at this stage there does not arise issue of revival of the suit inasmuch as the fate of the suit will depend upon the fate of the testamentary case.
