% 14.07.2016 By this petition, the petitioner seeks quashing of FIR No.103/2011 under Sections 419/420/468/471/120B IPC on the ground that parties have compromised the matter.

Learned APP for the State submits that though the petitioners and respondent No.2 have settled the matter, however besides the petitioners, there is one more accused in the present FIR namely Vinod Kumar, who was an MCD employee on contract basis. The allegations are that a part of property admeasuring 400 sq.yds out of the total property bearing No.C-9, SMA Indl. Area, GTK Road, Jahangir Puri, Delhi was given to Shri Gyan Chand Goyal and his brother on rent-cum-commission basis. Since the tenants did not vacate the premises, the owner of the property/complainant made a criminal complaint. During the investigation, it was revealed that after the expiry of the agreement, Gyant Chand and Sri Bhagwan got

electricity connection to run their factory on the basis of forged factory license in which the third co-accused who was an employee of the MCD on contract basis was involved.

Since allegations in the FIR relate to forgery of license which is an official document, even if the matter has been settled between the parties, this Court is not inclined to quash the FIR.

Petition is dismissed.
