The present petition has been filed under Section 401 Cr.P.C. against the order/judgment dated 07.12.2015 passed by the learned ASJ whereby the appeal filed by the petitioner against the judgment and order on sentence passed by the Trial Court vide orders dated 19.09.2015 and 16.10.2015 respectively whereby the petitioner has been sentenced to SI for six months under Section 279 IPC and SI for one year under Section 304A IPC, has been dismissed. 2.
The learned counsel for the petitioner, at the outset, has confined the relief in the present petition to reduction in the quantum
of sentence.

A perusal of the nominal roll shows that as on 16.08.2015, the petitioner served a sentence of eight months and eight days in judicial custody.

In the given facts and circumstances of the case, the sentence awarded to the petitioner by the Trial Court, as upheld by the appellate court, is reduced to SI for eight months under Section 304A IPC.

With the above modification in the order on sentence, the present petition accordingly stands disposed of. P.S.TEJI, J AUGUST 22, 2016/dm
