% 06.06.2016 CM(M) 579/2016 & CM No. 22100/2016 (stay) The above mentioned petition under Article 227 of the Constitution of India for setting aside the order dated 11th May, 2016 has been filed. The cost of Rs.20,000/- has been imposed. It is stated in the petition that on 11th May, 2016, learned counsel Sh. Dushyant Swaroop was admitted in the St. Stephens Hospital. Thus, he could not attend the Court. The only grievance of the petitioner is that the petitioner be heard for some time and the cost imposed due to non-appearance be waived. Matter is already coming up before the Court on 7th June, 2016. The learned Trial Court is requested to hear the submissions of the learned counsel for the petitioner. As far as the cost is concerned, in view of reasons explained the same is waived subject to the condition that the petitioner or his counsel would appear before the Court and no adjournment shall be taken on any ground.

The petition is disposed of.
