O R D E R

The petitioner has filed the present petition, inter alia, praying as under:- "i.

to issue, a writ, order or direction in the nature of Certiorari, quashing formation of as well as operation of Review Committee in respect of inquiry dated 12.08.2016 (Annexure-2).

ii.

to issue, a writ, order or direction in the nature of MANDAMUS commanding the respondent No. 1 & 2 to implement all recommendations of the enquiry report dated 12.08.2016 (Annexure-2) in letter and spirit expeditiously.

iii.

to issue, any other writ or order or direction for an enquiry through an independent agency, so that truth can comeout why and for what reasons respondents are protecting interest of a foreign company over national interest.

iv.

to issue, any other writ or order or direction in present circumstances of the case which petitioner could not sought due to lack in legal knowledge." 2.

Although, the petition lists out a series of grievances, some of which are also being agitated by the petitioner by the Allahabad High Court. The only grievance that the petitioner seeks to press before this Court is with regard to the report of the Review Committee which was formed to give a report in respect of the inquiry report dated 12.08.2016. According to the petitioner, the Review Committee has unjustifiably attempted to dilute the findings and recommendations of the Inquiry Committee. 3.

However, Ms Gosain, learned counsel for respondent no.2 points out that recommendations of the Inquiry Committee or the Review Committee are yet to be examined by the concerned authority. In the aforesaid view, this Court is of the view that it would be appropriate if the Secretary, Government of India, Ministry of Civil Aviation considers the Inquiry Report dated 12.08.2016 as well as the recommendations of the Review Committee and takes an informed decision as to any further steps that may be required.

The petitioner is also permitted to file a representation not exceeding 30 pages including all annexures (as has been requested by the petitioner); however, the petitioner shall confine his representation to only matters relating to the recommendations of the Inquiry Committee and the Review Committee. It is clarified that there is no requirement to grant any personal hearing or for further interaction with the petitioner; but, the concerned authority is expected to consider the representation while determining further steps that may be required to be taken.
