The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.1547/2015 registered under Sections 376 IPC and Section 4 POCSO Act at PS Uttam Nagar. Status report is on record. 2.

I have heard the learned counsel for the parties including the counsel for the complainant and have examined the file. The petitioner is in custody since 04.12.2015.

Upon completion of investigation, a charge-sheet has already been filed. On 25.07.2016, State was directed to examine the prosecutrix before the Trial Court. It is informed that the prosecutrix did not appear as purportedly she was not feeling well.

In 164 Cr.P.C. statement, the prosecutrix did not level any allegations against the petitioner for commission of rape. She rather accused her parents forcing her to make a statement against her boyfriend.

Considering the facts and circumstances of the case, the petitioner is admitted to bail on furnishing personal bond in the sum of ` 50,000/- with one surety in the like amount to the satisfaction of the Trial Court.

The bail application stands disposed of.
