This petition is filed under Section 11(6) of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as 'the Act') seeking appointment of a former judge of this court as a sole arbitrator to adjudicate the disputes between the parties.

In a similar matter with almost identical facts being ARB.

P.No.229/2017, titled as 'Metro Transit Pvt. Ltd. v. Government of NCT of Delhi', this court has appointed Mr.Justice R.C.Chopra (Retd.) as a sole arbitrator to adjudicate the disputes between the parties. 3.

Keeping in view the fact that the issues in the present petition are almost identical to ARB. P.No.229/2017, the present petition is also accordingly allowed in terms of the order passed in the said petition. 4.

Accordingly Mr.Justice R.C.Chopra (Retd.) (Mobile No.9818097777) is appointed as a sole arbitrator to adjudicate the disputes between the

parties. The appointment of the learned Arbitrator is subject to compliance of the provisions under Section 12(1) of the Act. The learned Arbitrator shall fix his fees in consultation with the learned counsel for the parties. 5.

The parties to appear before the learned Arbitrator on 24.05.2017 at 4.00 P.M.
