O R D E R
% 27.05.2016 This is a petition under Article 226 of the Constitution of India read with S. 482 Cr.PC moved by the petitioner for quashing of FIR No.364/2014 registered at Police Station Mayur Vihar, Delhi under Ss. 323/427/354/509/34 IPC and consequent proceedings emanating therefrom on the ground that the parties have compromised the matter.
A perusal of record goes to show that there is no settlement on record. Moreover, the affidavit of the respondent no.2, which is nothing but reproduction of the averments made by the petitioner in his affidavit which narrates that the petition has been drafted under her instructions. Moreover, learned ASC for the State submits that in fact there are three accused in this case whereas this petition has been filed by only one accused. As such, counsel for the petitioner, on instructions, seeks to withdraw the petition with liberty to file appropriate petition.
In view of these submissions, the petition is accordingly dismissed as withdrawn with liberty as prayed for.
