The present appeal has been filed by the Appellant -Rajeev under Section 374(2) of the Code of Criminal Procedure, 1973, assailing the judgment of conviction and order on sentence dated 08th July, 2008 and 11th July, 2008 respectively, passed by the learned Additional Sessions Judge, FTC, Rohini, Delhi, in Session Case bearing No. 236/2006 arising out of FIR No. 739/2006 registered under Sections 363/366/376 IPC at PS-Uttam Nagar. 3.

It is submitted that the Appellant was released from the jail on 20th June, 2011 after completing the sentence awarded to him. 5.

Learned Counsel for the Appellant submits that she has instructions from the Appellant to the effect that, as the Appellant has already served the entire sentence and so he does not wish to press the appeal, as the same has become infructuous.

Keeping in view the submission made on behalf of the Appellant, which is taken on record, and considering the fact that the Appellant has already served the sentence awarded by the Trial Court, the present appeal is disposed of as not pressed.
