O R D E R

% 13.02.2018 The learned counsel for the parties state that the lis has been settled amicably.

An amount of Rs. 3,86,000/- has been deposited before this Court. The same can be appropriated by the respondent along with interest accrued thereon. Additionally, the appellant shall pay an amount of Rs. 1,50,000/- to the respondent in two equal instalments: the first instalment of Rs. 75,000/- shall be paid on or before 28.02.2018 into the bank account of the respondent being SBI A/c No. 00000010469583799, Rohini Sector-18 branch, New Delhi; and the second instalment of Rs. 75,000/- shall be paid on or before 31.03.2018 into the said account. Any infraction of this arrangement either in terms of payment or the quantum or by the date, shall automatically be visited with a cost of Rs. 5,000/-, to be paid to the respondent within two weeks thereafter. The settlement includes the promise and commitment of the

respondent to withdraw the case viz. C.C. No. 50793/2016 pending under section 138 of the Negotiable Instruments Act, as well as the Execution Petition pending before the Sessions Judge, North-West, Rohini Courts, Delhi.

The parties have been identified by their respective counsels and state that they shall abide by the terms of this settlement. Additionally, their separate undertakings have also been filed and are taken on record. The appeal stands disposed-off in the above terms. NAJMI WAZIRI, J FEBRUARY 13, 2018 RW
