O R D E R

% 15.05.2018 C.M. APPL.20171/2018 The present joint application has been instituted on behalf of the parties under Order XXIII Rule 3 of Code of Civil Procedure, 1908, praying as follows:

"In view of the abovementioned facts and circumstances it is most respectfully to this Hon'ble Court may passed compromised decree in terms of Memorandum of Understanding/Settlement deed dated 10.05.2018 arrived at Delhi which is annexed as Annexure A."

A copy of the Memorandum of Understanding/Settlement Deed

dated 10.05.2018 is annexed along with the present application as Annexure A.

The application is duly supported by affidavits of the parties, who are present in person in Court today.

It is, therefore, jointly prayed that the present appeal may be disposed of, in terms of the aforesaid Memorandum of Understanding/Settlement Deed dated 10.05.2018. The said Memorandum of Understanding/Settlement Deed has been perused and the same is lawful. The said Memorandum of Understanding/Settlement Deed is hereby taken on record and exhibited as 'Ex-C1'.

The parties are, therefore, directed to comply with their reciprocal obligations thereunder, without demur. The parties are directed to take all necessary steps, in pursuance to the aforesaid Memorandum of Understanding/Settlement Deed, within the time frame stipulated therein.

The application is accordingly allowed.

The parties shall remain bound by the terms and conditions of the said Memorandum of Understanding/Settlement Deed.

The application is disposed of accordingly.

MAT.APP.(F.C.) 80/2016, C.M. Nos. 21984/2016 & 21985/2016 In view of an out-of-Court amicable settlement arrived at by and between the parties, by way of the Memorandum of Understanding/Settlement Deed dated 10.05.2018, the appeal is disposed of as having been compromised.
