% 02.09.2016 There are ten petitioners before this Court. They are stated to be vending from various sites which are at Nehru Place Complex, near Nehru Place Bus Terminal as also at Kalkaji. Learned counsel for the petitioners submits that they have been adequately protected under Section 3(3) of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014.
Learned counsel for the respondent submits that the only documents which have been placed on record by the petitioners are certain prosecution challans and they are also qua petitioner nos.1 to 9. Petitioner no.10 has no document in support of his case. These
documents do not vest any right in favour of the petitioners. Be that as it may, noting the above submission as also the fact the provisions of Section 3(3) of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 and the judgment of a Division Bench of this Court in LPA No.136/2016 Bhola Ram Patel Vs. NDMC & Others this Court is of the view that the grievances of the petitioners, if any, can be addressed before the Town Vending Committee qua respondent no.1/SDMC. Petitioner are at liberty to approach the TVC as when the TVC qua respondent no.1/SDMC is constituted.
This is order is qua petitioner nos.1 to 9 and not qua petitioner no.10.
Petition disposed of.
