Petitioner sought appointment with the respondent no.4/ONGC as a Director (Onshore). Petitioner also sought quashing of certain letters issued by respondent no.2/CVC. Due to subsequent events petitioner has already achieved the age of superannuation for the post of Director (Onshore) and even if the petitioner would succeed in this writ petition, petitioner yet cannot be granted appointment to the post of Director (Onshore) as he has crossed the age of superannuation. The petitioner is however not remediless because petitioner can always claim monetary benefits of the post in question of Director (Onshore) and to which he sought appointment to.

Since by the writ petition, the petitioner only seeks the relief of appointment to the post of Director (Onshore) of ONGC, this petition is thus allowed to be withdrawn with liberty to the petitioner to file an appropriate independent proceedings for seeking monetary reliefs of the post of Director (Onshore) of ONGC, and which liberty is given without in any manner opining on merits of the cases of the respective parties. 3.

Petition is accordingly allowed to be withdrawn with the aforesaid liberty.
