The second respondent though served with notice has not appeared on the matter being called out and kept in wait, it having been earlier passed over. No adverse order is passed today.

There is no appearance on behalf of the first respondent. It is noted that there is no formal service of notice on the first respondent till date, though there was appearance on his behalf through friend, as noted in the proceedings of 15.11.2018, no authorization or vakalatnama having been filed.

In these circumstances, appropriate course would be to call upon the petitioner to serve the first respondent. On appropriate steps being taken, fresh notice be issued to the first respondent, by all permissible modes, returnable for 26th March, 2019.
