% 28.08.2017 This is an application under Section 438 Cr.P.C filed on behalf of the petitioner for grant of anticipatory bail in case FIR No.25/2017, under Sections 457/380/511/34 IPC, registered at Police Station-Prasad Nagar, Delhi.
Learned counsel for the petitioner has submitted that the petitioner is an innocent person and having no nexus with the allegations as alleged in the aforesaid FIR. Counsel further submits that the petitioner has already joined the investigation and is ready to join further investigation as and when required to do so. Counsel further submits that the petitioner is not required for custodial interrogation and prays that the petitioner may be released on anticipatory bail.
Learned APP for the State on instructions from the Investigating Officer has submitted that the petitioner has joined the investigation and
supplementary charge sheet has already been filed. In these circumstances, the petitioner is further directed to join the investigation and in the event of his arrest the petitioner be released on anticipatory bail, on his furnishing bail bond in the sum of Rs.20,000/- with one surety of the like amount to the satisfaction of the Investigating Officer/SHO concerned with the condition that the petitioner shall not tamper with the prosecution evidence and he shall not leave the country without prior permission of the concerned Court below.
