% 05.07.2018 After some hearing, learned counsel for the appellant seeks permission to withdraw the appeal and states that the appellant would be taking appropriate steps for appointment of an arbitrator. In view of the statement made, the appeal is dismissed as withdrawn. All the pending applications and Caveat are also dismissed.

The learned Single Judge has, in the impugned order, itself mentioned that the observations made in the order under challenge would not in any manner bind or influence the arbitrator that may be appointed.
