% 14.07.2016 Present FIR under section 279/337 IPC was registered at police station Patel Nagar on the complaint of respondent no.2. In the FIR, respondent no.2 alleged that on 3rd May, 2016 at about 10:00 pm she was returning home along with her six year old daughter namely Renu after buying vegetables, when a Santro car bearing no.DL 2CAD 7305 hit her daughter resulting injuries on her right leg. Vehicle was driven by the driver in a rash and negligent manner.
She tried to stop the vehicle but driver escaped with vehicle. During investigation, it was revealed that petitioner was driving the vehicle.
Petitioner and respondent no.2 have settled the disputes amicably.
Petitioner has paid `22,000/- to respondent no.2 including the medical expenses.
Nature of injuries suffered by child is stated to be simple. Respondent no.2 is present in Court and submits that in view of compromise, she does not wish to pursue the FIR any further and same may be quashed.
Keeping in mind the nature of injuries and the fact that parties have settled their disputes amicably and in the interest of justice, FIR No.346/2016 under section 279/337 IPC registered at police station Patel Nagar and consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms.
