% 04.12.2018 Petitioner has assailed the order dated 30th January, 2016 passed by the learned Metropolitan Magistrate - 03, South - East District, Saket Courts, New Delhi, whereby respondents have been discharged. Remedy of filing Revision Petition under Section 397 Cr.P.C. is available to petitioner against the impugned order.

Learned counsel for the petitioner submits that petitioner may be permitted to withdraw this petition under Section 482 Cr.P.C. as petitioner intends to file a Revision Petition before the learned Sessions Judge. Petition is disposed of as withdrawn.

It is made clear that if any

application for condonation of delay is filed, the same shall be dealt with by the Revisional Court on its own merits and in accordance with law. Miscellaneous applications are disposed of as infructuous. A.K. PATHAK, J.
