$~16 * IN THE HIGH COURT OF DELHI AT NEW DELHI + W.P.(C) 5207/2016 & C.M. No.21644-45/2016 FARIDA BEGUM ..... Petitioner Through None.

versus SOUTH DELHI MUNICIPAL CORPORATION ..... Respondent Through Mr. Nikhil Goel and Mr. Ashutosh Ghade, Advs.

CORAM:

HON'BLE MS. JUSTICE INDERMEET KAUR

O R D E R

% 18.07.2016 The petitioner is aggrieved by the order dated 24.02.2015 wherein a demolition order had been passed qua the subject matter of the present writ petition. Admittedly an appeal has been filed against the said order which is pending before the ATMCD and the next date fixed before the ATMCD is in fact today for final arguments. The grievance of the petitioner is that the interim order has not been granted in his favour by the ATMCD.

Considering the fact that the main appeal is listed before the ATMCD, this prayer has become infructuous. None has appeared for the petitioner. This Court has been informed by the respondent that an appeal against the interim order not granting relief to the petitioner is also listed before the District Judge who is the appellate body of the ATMCD. This petition has become infructuous. Since none has appeared for the petitioner this petition is dismissed in default as also

in view of the prayer having become infructuous and this Court having noted the submission made in the pleadings itself in the main appeal which is listed before the ATMCD itself. Petition disposed of.
