After arguments, this appeal is disposed of as not pressed because at the request of counsel for the appellant/plaintiff this Court observes that in case the appellant/plaintiff succeeds in the suit, appellant/plaintiff will have the benefit of doctrine of lis pendens contained in Section 52 of the Transfer of Property Act, 1882. 2.

It is also agreed that both the parties will complete their evidence by filing affidavit by way of evidence or otherwise leading affirmative evidence in four opportunities each, failing which right to lead evidence of that party after four opportunities being granted will be deemed to be closed.

Appeal is disposed of accordingly.
