This order is in continuation of the earlier order dated 27th May, 2016. 2.

The respondent no.1 Reserve Bank of India in pursuance thereto states that response of the respondent no.2 Karina Fincap Ltd. was called to the earlier complaint of the petitioners and after perusal of the same the respondent no.1 RBI was satisfied and hence no action was taken. He further states that the subsequent complaint made by the petitioners is under examination in accordance with the Guidelines of Fair Practice for NonBanking Financial Companies and a decision would be taken thereon within three months.

Binding the respondent no.1 RBI to the aforesaid statement and with a direction to communicate the said decision to the petitioners, the petition is disposed of.

The senior counsel for the petitioners states that the respondent no.1 RBI may while taking a decision consider the judgment dated 28th October, 2013 in W.P.(C) No.1161/2010 titled Fortuna Foundation and Engineers and Consultants Pvt. Ltd. Vs. RBI and judgment dated 14th November, 2014 of the Division Bench of the Madras High Court in W.P.(MD) No.14627/2012 titled Ar. Jeyarhuthran Vs. The Union of India. No costs.
